In the name of Almighty God, I Reuben R. MARSHALL of the County of
Caldwell and state of Kentucky, being sound in mind and of disposing
memory and feeling the importance of properly arranging my temparal
affairs do stat , when I may be called hence, ther may be no difficulty in
regard to such ________as may by me left. I therefore do make and
ordain this my last will and testament, In the first place and above all I
command my spirit into the hands of my Merrciful Creator and my body to
the tomb and there I desire all my just debts of my character paid off out
of my personal estate.

! 2ndly, I will and bequeath to my son in law Robert R. FLEMING 174 acres of
land beginning at my upper corner tree and running down the River 87 poles
to two Elms and box Elders thence East 320 poles to a Ca__ white Oak
which is James DENNINGTON's corner tree thence South 9 degrees East 87
Poles to my upper and original line cornering in said line and then with sd
line West 320 poles to the beginning this tract of land I charge my son in
law Robert R. FLEMING seven dollars per acre in consequences of the white
Oak timber which he got with New Land, also a negro girl named Inidy 15 or
16 years of age for which I charge nine hundred and fifty dollars, the horse
bed card __given to him is not to be charged as I allow to give all my
children Equal in that respect without working my account of it.

! 3rdly I will and bequeath to my son John W. MARSHALL that tract or parcel
of land lying between Robert R. FLEMING's lower line and the big ditch
running down to the Ditch, thence East 320 Poles to James DENNINGTON's
line, thence with said line South & East to Robert R. FLEMING's white oak
____ tree, thence west with sd R. R. FLEMMING'S line 320 poles to the
beginning for which I charge five dollars per acre as my son John receives it
without white Oak timber or improvement (or at least without much
improvement) also a negro man named Joe about 24 years of age for whom
I charge Six Hundred and fifty Dollars. I also charge my son John W.
MARSHALL with cash paid for him five hundred and eighty eight Dollars &
69 cents for which I hold his note without interest, Also there is a small
book account that he must pay to me or to the estate, (I use the word
charge in this testament simply to show what I wish each of my children to
allow for their property in settling with each other)

! 4thly I will and bequeath to my son Gabriel R. MARSHALL THE TRACT OR
PARACEL OF LAND LYING BETWEEN THE Big Ditch and my lower line running
from the Mouth of said ditch down the River to my lower corner, thence
with my lower line East 320 poles to a Maple near corner of James YATES.
Thence South 9 East to a corner to be made by him and my son John W.
MARSHALL in James YATES or James 'S line as the corner from the mouth
of the Big Ditch (which is due East) may determine thence West to the
Mouth of the sd Ditch for which I charge seven dollars per acre in
consequence of improvements also a negro boy about 13 or 14 years of
age named Henry for whom I charge five hundred dollars. I also will my son
Gabriel R. MARSHALL my gold watch as an Extra compensation for his boy
Henry working for me, after my son Gabriel is of age.

! 5thly I will and bequeath to my two Grand Children Elizabeth Jane and
Reuben Ebenezer WALKER infant children of Chittenden and Nancy WALKER
(decd, as much in money as will equal one of my own children, my money to
be equally divided between Elizabeth Jane and Reuben Ebenezer WALKER, so
that the two grand children shall have as much as one of my own children.
Now their Mother Nancy WALKER bought a bear___ and small table at her
husbands sale which are with me yet, there was same thing over one
hundred dollars due my Grand children on Chittenden WALKERs estate and
rest of his land, which is Eighteen Dollars per acre ___ which I r___ I allow
to be applied to their raising clothing and education. I also will that each
one of them shall have a bed and beding and a horse sadle and bridle each
worth seventy five Dollars, which shall not be charged to them as I have
done towards my own children , Now if either of these my Grand Children
should die before receiving this property, the surviver be it which it may
shall receive the whole sum which is due to them both. And if they both
should die even after receiving the property to be equally divided amongst
the rest of my children.

! 6thly To my beloved wife Elizabeth, I will and bequeath during her natural
life the use and benefit of my houses and buildings of all discription house
hold and Chitden furniture (as such of it at least as she may chose or want
to keep for her own use) also my garden and orchard, also 25 acres of the
best corn land on my plantation also two of the best horses on the
plantation and yoke of Stears my waggon and two plows, all to be of her
own chosing. I also will to her during her life time, my servants Ellick and
Easter also as many cows and calves as she may want to keep for her own
use, also as many sows and pigs as she may think, merpany for her suppor,
she is to have the liberty of choosing such stock as she wants and if there
is any thing else, needed to make her perfectly comfortable in every
respect whatever, she is to have it without hinderance. I wish my sons to
pay strict attention to her and provid for her comfort in every respect and
not let her suffer for anything in life

! 7thly To my two sons John W. and Gabriel R. MARSHALL I will and bequeath
jointly two negroes, George about 20 years of age and Sam about 8 or 10
years of age, together with all my personal property, not otherwise
specifically devised, also all my personal and real estate which may remain
at my wife's death of any description, but, I wish it distinctly understood
that my John W. and Gabriel R. MARSHALL, shall pay to my two Grand
Children Elizabeth Jane and Reuben Ebenezer WALKER the sum which may
be due them according to the tener and specifications of this will and
testment and also to Robert R. FLEMING if after my estate is equally
divided amongst my children, he should not have received as much as any
one of the other children in that case, he shall receive what he lacks in
cash to make him equal with the other children, but my sons John W. and
Gabriel R. MARSHALL shall not be forced to pay the money over the heirs
under there years from my death in settling with the children they shall in
all cases be governed by the prices, which I have charged in this will and
testament.

! 8thly I will that my servant Willis shall have the liberty of hiring his own
time at the rate of five Dollars per a_____ so that he may stay with his
family and I wish my sons to protect him and see that no person shall
impose on him nor in any way mistreat him.

! 9thly If Gabriel R. MARSHALL's boy Henry should die before he receives
him, in that case, the sd Gabriel R. MARSHALL shall have credit in this will
and testament for the sum of five hundred Dollars

! 10thly The Expeication of this will and testament I have divided my tract
of land between my son in law Robert R. FLEMING and my two sons John W.
and Gabriel R. MARSHALL as I thought the ____situation required, Some
therefore will have more and some less They that have more must
therefore pay to the other children so as to make all my children equally
benefitted in my entire estate according to the prices and tenor of this will
and testament.

! Lastly, I appoint my wife Elizabeth as Executrix, my two sons John W. and

Executors of this my last will and testament and give to them or either of
them full authority to make conveyances of any real estate I may have

! Apparently after his father's (George Marshall, Sr.) death John
Washington Marshall was more or less the head of the fsmily. He and
Samuel P.L. were administrators of their father's estate.

! When their sister Joanna married John Jarrett on 4-17-1829 there was a
note written by John, dated 4-17-1829, stating that he had just returned
home from New Orleans and that Jarrett had made an agreement with his
brother, Samuel P.L. to meet him in the Clerks Office. He, John and Samuel
were busy with their goods (getting ready to open a retail store), so he was
sending theie brother, George, Jr., to meet with Jarrett at the Clerk's
Office (to apply for a Marriage License for Joanna and Jarrett).

! John and Samuel opened their retail business as partners. John became a
leading wealthy merchant in Eddyville and was identified with all public
enterprises and was a member of the Masonic fraternity.

styled as S&J Marshall. Samuel was the first Judge when Lyon County was
formed in 1854. He moved to Cherokee County, AL and owned many slaves.
He made a large investment in the iron industry around Mount Furnace. the
furnace was destroyed by the Union Army and he lost everything.

! Martha was the third child of Reverand Reuben R. Marshall, born 1794 in
Scott County, KY and Elizabeth James, born 1798 in VA, a duaghter of
Thomas James, Sr., a Lieutenant in the Revolutionary War, and Elizabeth
Robinson.

! Martha surely had stressful and trying times. In 1849 she was
two months pregnant with her fourth child, John, when Mildred, her third
child died at two years of age.

! In April 1857 her husband died of winter fever. About four months
later on August 7, 1857 her first child Martha died from lockjar at three
years of age.

! She was appointed administrix of her husband's estate on 10-20-1857,
but she relinquished her right of guardianship of her remaining children -
Nancy, John, Isabella, Sarah, and Gablriel to her father Reuben. His
guardianship put him in charge of their finances and explains why they were
listed as Marshall's in the 1860 census, even though they lived with their
mother.

! Out of the eight children, only three lived to be adults, the other death
dates are not known.

! It is probable that both Martha and Robert R. are buried at Jones
Cemetery and their markers probably destroyed during the 1937 Flood.
There are many immediate family members buried there.

! BURIAL: He was buried in Jones Cemetary, Lyon County, KY, located on the
Cumberland River a stone's throw from Barkley Dam. His wife, Sarah
Elizabeth Rucker, is probably also buried there. The story goes that during
the 1937 Flood the cattle were let into the cemetary to keep them from
drowning and many markers were destroyed. John W. Marshall's marker
was one of them.

! BIOGRAPHY: After John W.'s death, Stephen H. Doom was guardian for his
children, Isaac, Reuben and Gideon Cobb., October 7, 1875. There was a
guardian report to the Court of a note against John Jones, administrator of
Isaac Rucker, deceased, for the amount of $231.14. James B. Marshall
must have died before this date since he is not listed as one of the

Wm. "Buck" Johnston, and later married her daughter Mary. Their marriage
record, dated 4-1-1877, states he was 40 years old and Mary was 18. She
died at age ninety.

! Matthew C. Marshall's early life was spent in attending school. At fifteen
years of age he went to Camp Boone, Tenn., to enlist in Confederate
service; was there rejected, owing to age and size, but being determined,
again subsequently went to Bowling Green, and was there a messenger for
Gen. Albert S. Johnston; served with him until surrender of Ft. Donelson;
when he was given a pass and returned home.

! Upon returning to Eddyville he accepted a situation as a salesman with
James O'Hara, where he remained until 1869, when he accepted a position
with the Mississippi Railroad as assistant agent at Vaiden, Miss., holding
that position till June, 1870, when he went to Evansville, Ind., taking a
position with Morgan, Read & Co., wholesale boots and shoes.

! Then retiring from business Matthew engaged with Simmons, Dixon & Co.,
wholesale boots and shoes, where he remained until February, 1873, when
he returned to Eddyville and bought the stock of dry goods, etc., belonging
to the estate of James O'Hara, and continued there till January, 1881,
when he moved his stock to Kuttawa, and has since conducted the
business, carrying a general stock of dry goods, boots, shoes, etc.

! July 20, 1876, he married Miss Helen M. Shelby, of Lyon County, daughter
of Clark and Helen Shelby, both parents deceased. Subject has one child,
Miss Mary P., at home.

FOLKLORE STORY

! This week I will take a break from the purely historical and statistical
history and write about something a little more lighthearted and humorous.
A folklore story or tale is generally made up of part fact and part guessing
or assuming what happened. This story deals with a legendary counterfeit
operation in Lyon County. A folklore story is one generally spoken, rather
than written, and each person telling the story relates a different version.

! The facts of the Lyon County folklore story are as follows: Daniel Jarrett,
believed to be from North Carolina, came on the scene in Caldwell County,
now Lyon County, shortly after 1800. He no doubt was a man of
considerable wealth because the early deed books show where he bought,
sold or exchanged many acres of property. He owned a house and lot in
Princeton. He purchased a 500 acre tract of land on the Cumberland River
between Iuka and Dycusburg. He obtained a license from Caldwell County
Court to operate a ferry on the Cumberland River. In 1810 he purchased a
500 acre tract of land at the intersection of the Varmint Trace Road and
Spring Creek. About 500 yards north of the road, and near the creek was a
huge spring measuring about thirty feet in diameter across the top, and
because of its great depth, has always been called the "no bottom spring."
A one hundred foot roll of rope with a rock tied on for a weight did not
touch bottom.

! Here at the no bottom spring, along Spring Creek, Daniel Jarrett and his
wife, Margaret, built a fine, up-to-date, modern two-story log house, much
superior to a log house built by ordinary settlers. I was unable to find where
the court issued a license to Daniel Jarrett to operate an Inn and Tavern;
however, I do believe that he operated such a business because of his
operation of a ferry on the river, and the location of his house on the much
traveled Varmint Trace Road. Word of mouth information from many of the
older people reveal that the Jarretts hosted frequent and lavish parties.
They had fiddling and dancing along with lavish food and drink.

! The foregoing information for the most part is factual and true, but now
as we come to the illegal operations, facts are not prevalent, and one must
fill in the blanks with what is believed to have happened.

! Legend reveals that the Jarretts were involved in counterfeit money
operation in an upstairs room of their log house. Because of their lifestyle,
suspicion began to rise as to where thc money was coming from. This
suspicion finally came to thc attention of the law.

! One night while a party was going on , two officers appeared at the
Jarrett home. I do not know if they were deputy sheriffs or someone else,
but I am inclined to believe they were federal marshals. Daniel Jarrett no
doubt had some insight into who the persons were and what their purpose
was at his house. He extended the most cordial hospitality to the strangers
and invited them in to join the party. They accepted his invitation and began
to participate in the dancing, eating and drinking, and other festivities.

! While the officers were enjoying the party, Daniel Jarrett sent two slaves
upstairs and they lowered a trunk of counterfeit money, and all the
counterfeit equipment and apparatus by a rope, out the window, to the
ground. They then came downstairs and carried the trunk of money and all
the other evidence of the counterfeiting operation and cast them into the
no bottom spring.

! After the party was over and the officers presented their search
warrants to Daniel Jarrett the evidence was already sinking into the no
bottom spring.

against Daniel Jarrett. A great grandson of Daniel Jarrett, Ben Jarrett,
always carried an old key in his pocket, show it and say, "If anybody ever
fishes that trunk of mkoney from the spring, I have the key to open it".

! Daniel Jarrett died in 1841 and is buried in the family graveyard on a hill
behind the house and big spring. The graveyard has been destroyed by a
bulldozer. About two years ago, this writer took a steel rod for a prod, and
found the tombstone of Daniel Jarrett under about four inches of dirt, and
broken into two pieces. I dug it out and put it together and it revealed the
following information: "Sacred To the Memory of Daniel Jarrett, April 10,
1770 - December 12, 1841."

! In a short will, his entire estate was bequeathed to his wife, Margaret,
with no indication of the value of his estate.

! The 1900 Lyon County census shows Isabella (Peek) Fleming) Undisclosed in the
household of Thomas Logan Boucher and her daughter, Madora (Dora)
Adeline. Also included were Isabella's grandchildren Lora (12), Josephine
(10), Edgar (4), and Russell (2). They were the children of Mary Belle Koon
(Fleming) who died May 18, 1900). It is not known what happened to their
father, Jefferson Davis Koon.

Robert, who had just died a few months earlier at age of eight
Mary Lou, 6 years old and
Jennie was only 3 weeks old

life, her grandfather & grandmother met in Smithland, KY.

! Kate was a native of Kuttawa, moved to Grand Rivers in 1907 (formerly
known as Nickellville) and lived there until 1923 when she moved to Paducah
where she was a teacher in the Paducah schools for 46 years. She was the
daughter of Madora Adeline Fleming and Thomas L. Boucher.

! The 1900 Lyon County census shows Isabella (Peek) Fleming Undisclosed in the
household of Thomas Logan Boucher and Madora (Dora) Adeline. Also
included were Isabella's grandchildren Lora (12), Josephine (10), Edgar (4),
and Russell (2) children of Mary Belle (Hinshaw) and J.D. Koon.

! Mary Ilene Fleming (Hinshaw born in 1894), wrote of "Aunt Bell", as part of
her childhood remembrance in THE SPREADING WHITE OAK. This is Mary
Belle Fleming as confirmed when Ilene refers to the children Lora and
Josephine and "the two little boys" (Edgar and John). Ilene was only six
years old when "Aunt Bell" died. in 1900.

! "Mama called me to come to her at the steps of the old hall. I went to her
in my dreamy spell, steps slow and lazy-like. She said "You remember Aunt
Bell", "yes'um", "Well, she's dead". I turned in childish sadness to go back
to weep at the roots of the Old Oak, somehow that day - already the
breezes whispering in her boughs - had had a strange sadness, or
something, something sacred, something I didn't understand.

! "Now, I didn't know what it was! As I crouched into the crevice at the
base of the dear Old Oak, where two huge roots branched out to sink deep
into the earth - leaving a sort of niche, I nestled there saying over and over
"Aunt Bell's dead, she's dead right now, Aunt Bell's dead. Yes, Josephine,
and Lora and the two little boys have no Mama now."

! "As I sat in stillness, hearing the rustling of the tiny new leaves and
watching a beautiful butterfly sailing by me and on toward the stable, my
childish fancy followed on. But the May breezes whisked by and carried last
year's oak leaves with them down to the ravine below, and I saw the green
saplings waving in the gentle wind it seemed they pointed upward. I looked
up too, at the blue sky and the high billowy-white clouds floating there like
huge gobs of foam off the soap kettle, when Mama used to make soap. I'd
get some of the warm liquid soap and put it into a pan and add some water
and whisk and swish it into foamy bubbles, and then blow big gobs of these
out into space and see them float off; wondering where they were going
and why some went one way and some another and wishing I could somehow
go with them.

! "Now, there were those beautiful clouds, handing up there, never moving it
seems. Oh yes, I knew they were sad too, 'cause Aunt Bell was dead. A
dreadful silence came over the woods. I looked back toward the house and
there stood the chickens back under the edge of the house. Some were
just standing and staring, and some with one foot tucked up under their
feathers. After a little they'd put one foot down and put the other one up,
yes they were sad too because of the same reason I was!

! "And one of Papa's hounds came out from away back under the floor, he
was slow and sad-like too. When he got to the edge of the floor the
chickens moved over, out of his way, and he came out into the sun and
stretched and yawned, bowed his back away high, his head and tail down,
then stretched his forepaws out front and let his belly go so low it touched
the ground, and opened his mouth and gaped like the baby did when she was
first born, and walked slow-like down toward me. I knew he was awful sad
too, he didn't act like that all the time.

! "Well, whatever it was that made her die, it sure was making me sad.
Everything said, 'Aunt Bell's dead', and it became something like a million
voices. Everywhere I looked, everything said it; the trees, the clouds, the
chickens, even the old mules, standing in the lot, and the poor little calves
in the calf-lot, standing wagging their tails and standing by the fence with
their heads down. Maybe they were thinking s'pose their Mama died out in
the woods, and would never be home again. Oh, this awful. Whatever it was
that took Aunt Bell away from Lora and Josephine made everything so
unhappy!

! "Yes, Aunt Bell is dead. The wind is even saying so, it's telling everything.

Yes, there it goes down there in the thicket shaking all the trees and telling
them, even the tall grass beside the road, he has stooped down and told it.
Now the beautiful white clouds, that were standing about have changed.
They have changed! I know they know it too, for they're not happy-looking
any more, they're not white and fluffy at all. They're turning black and all
flattened out. Some of them are scurrin' around and running across the
sun, and making it dark here too.

!I "I know everything feels sorry and sad too, for the wind is telling
everything. But why don't it quit telling me? Every time it passes by it tells
me again and when I put my hands over my ears, it gets high in the limbs of
the Old Oak tree and says it louder so it'll make me hear again. I wish it
would go away and quit telling me! I know it! Everything knows it! Now, the
sun has gone away! I wonder why? I guess it has gone away by itself too,
and the pretty white clouds have all turned black! And it's black and dark
now in the hollow!

! "Oh, that sounds like thunder away over across the river! Why, that is
where Aunt Bell lived. That's where she is now, dead - and they're going to
bury her down there in the family graveyard! I wonder what a family
graveyard is? They say I have lots of cousins buried there and my
granddpap that was an old soldier. Well, everything knows about him too.
They say he was a fine man. Maybe that thunder over across the river is
telling everything over there too, now that Aunt Bell is dead. Yes, I know
that is what's happening for way over there in their direction, it's awful
looking - the sky is black as night."
